TERMS AND CONDITIONS FOR ORDERS PLACED ONLINE AT www.jazzymango.com

  1. GENERAL PROVISIONS
  2. Jazzy Mango Online Store with its registered office in POLAND, Pabianice 95-200, 4 Krakowska street, Tax number: 7311928009 available at: www.jazzymango.com (hereinafter referred to as the “Online Store”) is run by Justyna Kociszewska, mailing and delivery address: Jazzy Mango Justyna Kociszewska, 36/1 Sienna street, 95-200 Pabianice, POLAND, e-mail address: contact@jazzymango.com, telephone number: 0048 508 537 088 (fee as for a standard call – according to the price list of the relevant operator).
  3. These Terms and Conditions are addressed to Customers who are Consumers, i.e. natural persons who perform a legal action with the entrepreneur not directly related to their business or professional activity and define the rules of using the Online Store, conditions for placing orders for Products available in the Online Store, time and rules for implementation orders, terms and forms of payment, the Customer’s rights to cancel, return the order and withdraw form the contract as well as the rules for submitting and considering claims.
  4. The information presented in the Online Store is only an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code, and not an offer in accordance with the provisions of the Civil Code.
  5. The store conducts retail sales on the territory of POLAND, the European Union and outside it via the website using means of distance communication. Using the Online Store requires that the end devices and the IT system used by the Customer meet the relevant technical requirements.
  6. The Customer is entitled and obliged to use the Online Store in accordance with its intended use.
  7. The Customer is obliged to refrain from any activity that could affect the proper functioning of the Online Store, including in particular any interference with the content of the Online Store or its technical elements, including the provision of illegal content. It is forbidden to use for purposes other than its intended use, including, in particular, sending spam, conducting any commercial, advertising, promotional, etc. activities on the websites of the Online Store.
  8. The Online Store is not responsible for any disruptions in the functioning caused by force majeure, unlawful actions of third parties or incompatibility of the Online Store with the Customer’s technical infrastructure.
  9. Viewing the assortment of the Online Store does not require registration. Independent placing of orders by the Customer for Products in the Online Store’s assortment requires registration in accordance with the provisions of point II. of these Regulations, or allows you to place an order without registration and the need to create an account, directly on the website of the Online Store www.jazzymango.com.
  10. Payments for orders placed in the Online Store are accepted with secure online payments using Przelewy 24 website (bank transfer service), PayPal, Credit card (Mastercard, Visa) or by traditional transfer to the account of the Online Store operator (only for payments in PLN).

  1. Acceptance of the Terms and Conditions is voluntary, but necessary to create an account and/or to place an order by the Customer.

 

  1. CONDITIONS AND ORDER PROCESSING TIME
  2. By placing an order in the Online Store, the Customer concludes a sales contract for the ordered from the Store.
  3. The store allows the customer to place an order as a Guest of the Website or after registering an account, which must be made by completing the “registration form” when placing an order via the website: www.jazzymango.com.
  4. After registering in the Online Store, the Customer places an order by indication of the Products she/he is interested in on the Product Page, selects the “Add to Bag” (“Add to Cart”) command on the Product Page, and then in the Bag/Cart indicates the delivery and payment method and confirms the order.
  5. In the Bag/Cart, the Customer indicates:
  6. a) ordered Products and their quantity;
  7. b) the address to which the subject of the order is to be delivered and the data necessary to issue an invoice.
  8. c) delivery method – com cooperates with the following courier companies: InPost (automated parcel machines within POLAND), DHL; DPD, GLS, UPS, FedEx, Poczta Polska (Polish post office – international deliveries).
  9. d) method of payment (details are included in point III.2 of these Terms and Conditions);
  10. e) discount code – discount codes cannot be combined and only one code can be used when placing an order.
  11. In the event of providing false data, the Online Store has the right to withdraw from the order by notifying the Customer about it.
  12. Shipment of the purchased goods is usually carried out within 5 (five) working days, the date of which is counted from the date of payment confirmation on the Store’s account. In the event of inability to complete the order within the indicated period, the Online Store undertakes to notify the Customer of the above.
  13. Electronic orders can be placed 24 hours a day throughout the year. Orders placed on Saturdays, Sundays and public holidays will be processed on the next working day.
  14. If the order is not paid within 5 (five) working days from its submission, the order will be canceled. In this case, you can place the order again. The implementation of the order payable by bank transfer, Credit Card, secure online payments, PayPal begins after the payment is credited to the Online Store’s bank account.
  15. In the event that the implementation of part of the order is not possible, the Online Store may offer the Customer:
  16. a) cancellation of the entire order (if the Customer selects this option, the Store will be released from the obligation to complete the order);
  17. b) cancellation of the order in part, the implementation of which is not possible within the scheduled date (if this option is selected by the Customer, the order will be completed in part, while the Store will be released from the obligation to perform it in the remaining extent);
  18. c) implementation of a replacement service, which will be confirmed with the Customer. An order based on a replacement service, after approval by the Customer, will be treated as final;
  19. d) division of the order and setting a new deadline for this part of the order, the implementation of which is not possible within the scheduled date (if the Customer chooses this option, the products will be sent in several separate shipments, and the Customer will cover the additional costs related to splitting the order into several shipments).
  20. If the ordered Product is not available in the Online Store or it is not possible to fulfill the Customer’s order for other reasons, the Store will inform the Customer about it by sending information to the e-mail address provided during registration within 7 (seven) days from the contract conclusion date.
  21. If it is not possible to complete the order in whole or in part, the Online Store will refund the amount paid (or the difference) to the Customer within 14 (fourteen) working days from the date of sending the information to the e-mail address provided during registration.
  22. If the Customer provides incorrect or inaccurate data, including in particular an incorrect or inaccurate address, the Online Store shall not be liable for failure to deliver or delay in delivering the subject of the order to the fullest extent permitted by law.

 

III. PRODUCT PRICES, PAYMENT METHODS AND DELIVERY COSTS

  1. The prices of goods are gross prices and are given in PLN (Polish zlotys), EUR or USD.The prices of goods do not include shipping costs.
  2. The customer has the option of paying the price with secure online payments using Przelewy 24 website, by Credit Card, by PayPal or by traditional transfer to the account of the Online Store operator (within POLAND and in PLN):

  1. The Online Store reserves the right to change the prices of goods in the Store, introduce new goods for sale, carry out and cancel promotional campaigns, or introduce changes to them in accordance with the standards of the Civil Code and other laws, and such changes do not violate the rights of persons,who concluded sales contracts of goods offered by the Store before the above-mentionedchanges or rights of persons entitled to use a given promotion, in accordance with its rules and throughout its duration.
  2. Shipping costs are added to the sum of the ordered Products, they will be indicated at the time of ordering and are borne by the customer.

However, various countries may incur VAT, tax, and custom duties appropriated by your local postal provider and government.

  1. a) For International shipping to the USA, Canada, Australia, New Zealand (or other territories where the Products may require custom duties, import taxes or other taxes with similar effect) customs taxes and/or duties are imposed by your country. It is completely out of control of Jazzy Mango Online Store. Please contact your local customs office to find out if you will be charged and what the charges are before placing your order.
  2. The delivery of goods is limited to the territory of the Republic of POLAND, the European Union and countries outside the EU (such as: United States of America, Australia, New Zealand, Canada) and takes place at the address indicated by the Customer when placing the order.
  3. The delivery of the ordered goods takes place via courier companies: InPost (automated parcel machines within POLAND), DHL; DPD, GLS, UPS, FedEx, Poczta Polska (Polish post office – international deliveries).

  1. When collecting the parcel delivered by the courier, the Customer should check the condition of the outer packaging of the parcel in his presence. If the package is damaged, make a damage report in two identical copies signed by the recipient and the courier.
  2. a) For local deliveries, in the case of collection of the parcel at the InPost automated parcel machine, the claim should be made directly upon receipt, in accordance with the instructions provided by the operator.

 

  1. PRODUCT COMPLAINT – REPORT A DAMAGED PRODUCT/DEFECT
  2. The grounds, responsibilities and extent of the Seller’s liability towards the Customer, if the Product sold has a physical or legal defect (warranty) are specified in the provisions of the Civil Code, in particular in Art. 556 and following of the Civil Code.
  3. A complaint may be submitted, a damaged Product may be reported by the Customer:
  4. a) in writing to the following address: Jazzy Mango Justyna Kociszewska, Sienna 36/1, 95-200 Pabianice, POLAND; or
  5. b) via e-mail to the following e-mail address: contact@jazzymango.com, in the title of the message by entering: Complaint and the order number it concerns; or
  6. c) using the “claim form” available on the com website.
  7. If the sold Product has a defect, the Customer may:
  8. a) submit a declaration of price reduction or withdrawal from the sales contract, unless the Seller immediately and without undue inconvenience to the Customer replaces the defective Product with a Product free from defects or removes the defect. The reduced price should remain in proportion to the price resulting from the contract in which the value of the defective Product remains to the value of the defect-free Product. The Customer may not withdraw from the contract if the defect of the Product is irrelevant;
  9. b) demand replacement of the Product with a Product free from defects or demand removal of the defect. The Seller is obliged to replace the defective Product with a Product free from defects or remove the defect within a reasonable time without undue inconvenience to the Customer, with reservations and on the terms set out in the relevant provisions of the Civil Code.
  10. The Customer may, instead of the removal of the defect proposed by the Seller, demand that the Product be replaced with a Product free from defects, or instead of replacing the Product, demand that the defect be removed, unless it is impossible to bring the Product into compliance with the contract in a manner chosen by the Consumer or would require excessive costs compared to the method proposed by The seller. When assessing the excess of costs, the value of the Product free from defects is taken into account, as well as the type and significance of the defect found, and the inconvenience to which the Consumer would be exposed to another way of exercising his rights.
  11. The Seller will respond to the Customer’s complaint immediately, no later than within 14 (fourteen) days from the date of its receipt. If the Customer requested replacement of the item or removal of the defect, or submitted a price reduction statement, specifying the amount by which the price is to be reduced, and the Seller did not respond to this request within 14 (fourteen) days from the date of its receipt, it is considered that the Customer’s request was considered justified.
  12. If the Seller responds to the Customer’s complaint or to exercise the Customer’s rights under the warranty, it will be necessary to deliver the Product to the Seller, in accordance with Art. 561 with reference 2 in connection with Art. 354 § 2 of the Civil Code, the Customer is obliged to contact the Online Store at the address contact@jazzymango.com to determine the method of delivery.
  13. The Seller is liable under the warranty if a physical defect is found within two years from the date of delivery of the Product to the Customer. The claim for the removal of the defect or replacement of the Product with a Product free from defects expires after one year from the date of finding the defect, however, the limitation period may not end before the expiry of the period referred to in the first sentence.
  14. The differences between the visualization of the Product resulting from the individual settings of the Customer’s computer (color, proportions, etc.) and the actual appearance of the Product cannot be the basis for the complaint. In this case, the Customer has the right to withdraw from the contract in accordance with the provisions of point V of these Terms and Conditions.

 

  1. RIGHT OF WITHDRAWAL
  2. A Consumer who has concluded a distance contract may withdraw from it without giving any reason and without incurring any costs than provided for by law, within 14 (fourteen) days (“Ustawowe Prawo Odstąpienia” in Polish – “Statutory right of withdrawal”), the period of withdrawal from the sales contract begins from the day the Product is taken over by the Consumer or a third party designated by him, other than the carrier, and in the case of a sales contract, which:
  3. a) includes many Products that are delivered separately, in batches or in parts – from taking possession of the last Product, batch or part, or
  4. b) consists in regular delivery of Products for a specified period – from taking possession of the first of the Products.
  5. To meet the above deadline, it is enough for the Consumer to submit an unambiguous statement in which she/he will inform the Seller about his withdrawal from the sales contract. The declaration of withdrawal from the sales contract may be submitted, for example:
  6. a) in writing to the following address: Jazzy Mango Justyna Kociszewska, 36/1 Sienna street, 95-200 Pabianice, POLAND; or
  7. b) in electronic form via e-mail to the following address: contact@jazzymango.com, entering in the title of the message: Withdrawal from the contract, invoice number; or
  8. c) using the “withdrawal form” available on the website jazzymango.com.

The consumer may use the “withdrawal form” template, but it is not obligatory.

  1. In the event of withdrawal from a distance contract, the contract is considered void.
  2. The Seller is obliged to immediately, no later than within 14 (fourteen) days from the date of receipt of the Consumer’s statement on withdrawal from the contract, return to the Consumer all payments made by her/him, including the cost of delivery of the Product (except for additional costs resulting from the chosen by The Customer’s delivery method other than the cheapest standard delivery method available in the Online Store).
  3. If the Consumer exercises the “Statutory right of withdrawal”, the Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of return which does not involve any costs for him. If the Seller has not offered to collect the Product from the Consumer himself, he may withhold the reimbursement of payments received from the Consumer until he receives the Product back.
  4. The consumer is obliged to immediately, no later than within 14 (fourteen) days from the date on which he withdrew from the sales contract, return the Product to the Seller or hand it over to a person authorized by the Seller for collection, unless the Seller has offered to collect the Product himself. To meet the deadline, it is enough to return the Product before its expiry to the following address: Jazzy Mango Justyna Kociszewska, 36/1 Sienna street, 95-200 Pabianice, POLAND.
  5. In the event that the Consumer exercises the “Statutory right of withdrawal”, he is liable for the decrease in the value of the Product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product. The Consumer’s responsibility may include, in particular, the inability to sell the Product as a full-value Product, the costs of re-placing tags and security elements on the Product, as well as the costs of restoring the Product to a state that allows it to be re-sold in the Online Store, including the costs of testing the Product by a specialist and the costs of removing defects found as a result of such examination (to the extent that these defects result from the use of the Product by the Consumer in a way that goes beyond what is necessary to establish its nature, characteristics and functioning).
  6. If the Buyer withdrew from the Contract despite the lack of grounds or after the deadline and returned the item to the Seller, he is obliged to collect the item from the Seller at his own expense and on his own. The Seller may return the Goods returned to the Buyer after the Buyer has paid the shipping costs; until then, the Seller may withhold shipping. The risk of loss or damage to the Goods in return transport is borne by the Buyer.
  7. By withdrawing from the contract, the Customer agrees to the processing of her/his Personal Data on the basis of Article 6 (1) letter c of the General Data Protection Regulation (GDPR) of 27th April 2016, in the extent: name, surname, e-mail address, telephone number, bank account number by Justyna Kociszewska running the Online Store at the address: www.jazzymango.com, running a business named Jazzy Mango Justyna Kociszewska with its registered office in POLAND, 4 Krakowska street, 95-200 Pabianice, Tax number: 7311928009. The consent is granted to entities dealing with legal and tax services, accountants, entities participating in payment transactions, external service providers processing information in order to reimburse the purchased goods as a result of withdrawal from the contract. Please be advised that Personal Data will be stored for a period of 5 (five) years and that the Customer has the right to request the Administrator to access Personal Data, the right to rectify, delete or limit processing, the right to object to processing, as well as the right to data portability; has the right to lodge a complaint with the Personal Data Protection Office (UODO in Polish) when it is justified that Personal Data is processed by the Administrator contrary to the provisions of the General Data Protection Regulation (GDPR) of 27th April 2016.

 

The Customer is aware that providing Personal Data is required in order to refund and pay the amount due. As a consequence of not providing the above-mentioned Personal Data, there is no possibility of reimbursement.

 

  1. REFUNDS
  2. The Store will refund the amount due within 14 (fourteen) calendar days using the same payment methods that were used by the Customer in the original transaction, in the case of:
  3. a) cancellation of the order or part of the order (in that case the appropriate part of the price will be refunded) paid in advance before its implementation;
  4. b) returning the Product (withdrawal from the contract) from the order, which was delivered via one of the courier companies: InPost, DHL, DPD, GLS, UPS, FedEx, Poczta Polska;
  5. c) accepting the complaint and inability to repair the damaged Product or replace it with a new one;
  6. d) recognizing the right to demand a reduction in the price of a Product.
  7. Any costs incurred resulting from item(s) being returned to Jazzy Mango Online Store due to failure to make payment will be borne by Customer. Any balance will then be credited back to Customer’s account within 14 (fourteen) working days.

 

VII. PERSONAL DATA AND PRIVACY POLICY. INFORMATION OBLIGATIONS

  1. Personal Data provided by the Customer in the registration or ordering process are processed by Jazzy Mango Justyna Kociszewska, address: 4 Krakowska street, 95-200 Pabianice, POLAND, Tax number: 7311928009, which is the Administrator of Personal Data.
  2. An indispensable element of the account creation and ordering procedure is the Customer’s provision of his Personal Data, marked as mandatory, and his consent to the processing of her/his Personal Data provided during registration. Providing Personal Data is voluntary, but necessary for registration and placing an order, its implementation and service.
  3. The consent to the Personal Data processing takes place by checking the appropriate box in the form by the Customer.
  4. The collected Personal Data is not made available to third parties, except for the transfer of data to entities participating in the implementation of the order and in order to deliver the ordered goods to the Customer, i.e. external service providers processing information for the purposes of order fulfillment, such as courier companies, entities dealing with legal and tax services, participating in payment transactions, IT service companies, identity management, hosting and website management, data analysis, backup, security and data storage. The scope of the transferred data is limited to the necessary minimum, in accordance with the principle of Personal Data minimization.
  5. Customers’ Personal Data will not be profiled and will not be transferred outside the European economic area in the case of orders within the European Union.
  6. a) Personal Data of foreign Customers may be transferred to related entities for the purpose and scope of the order and concluded contract. This may involve transferring data outside the European Economic Area (depending on the place of shipment). In this case, the Customer’s Personal Data is protected by standard data protection clauses adopted or approved by the European Commission, or another measure that, in accordance with the GDPR (RODO), provides adequate security in the event of Data transfer to third countries (e.g. Privacy Shield Program – Privacy Shield in the USA ). The data subject may request a copy of the transferred Data and an indication of the place where they are made available. In this matter, please contact the Personal Data Administrator.
  7. The Customer has the right to request the Administrator to access Personal Data, the right to rectify, delete or limit processing, the right to object to the processing, as well as the right to transfer Data. The Customer also has the right to lodge a complaint with the Personal Data Protection Office (UODO in Polish) when it is justified that her/his Personal Data is processed by the Administrator contrary to the provisions of the General Data Protection Regulation of 27th April 2016, called “GDPR” For this purpose, he should contact the company at the following address: Jazzy Mango Justyna Kociszewska, 36/1 Sienna street, 95-200 Pabianice, POLAND, or by e-mail to the following address: contact@jazzymango.com.
  8. The Customer has the right to obtain information whether and to what extent her/his Personal Data are processed, as well as information about the purpose and scope of processing her/his Personal Data. For this purpose, the Customer should contact as indicated in point 6.
  9. Jazzy Mango Justyna Kociszewska, 4 Krakowska street, 95-200 Pabianice, POLAND as the Personal Data Administrator, may entrust another entity, by way of a written contract, with the processing of Personal Data, in compliance with the provisions of Art. 28 GDPR.
  10. The Online Store at www.jazzymango.com uses “cookies”.
  11. Detailed provisions concerning the Privacy Policy are available at www.jazzymango.com.

 

VIII. FINAL PROVISIONS

  1. The Terms & Conditions and (any attachments to the Terms & Conditions) constitute a standard contract within the meaning of Art. 384 § 1 of the Civil Code.
  2. The Seller may amend the Terms & Conditions, and in the event of changes to the Terms & Conditions, the Seller will provide the consolidated text of the Terms & Conditions by publishing in the Online Store and by means of a message sent to the e-mail address provided by the Customer when concluding the Service Contract, which The parties consider it to be the introduction of information about the change to the means of electronic communication in such a way that the Customer can read its content.
  3. The amendment to the Terms & Conditions comes into force 14 (fourteen) days from the date of sending the information about the change. In the case of Customers who have concluded a Service Contract, i.e. who have an Account, they have the right to terminate the Service Contract within 14 (fourteen) days from the date of notification of the amendment to the Terms & Conditions. The amendment to the Terms & Conditions does not matter for the Sales Contracts concluded by the Customer and the Seller before the amendment to the Terms & Conditions.
  4. The owner points out that the Online Store contains content protected by intellectual property law, in particular works protected by copyright (content posted in the Store, layout, graphics, photos, etc.). Customers and Visitors to the Store undertake to comply with intellectual property rights (including proprietary copyrights and industrial property rights, such as rights resulting from the registration of trademarks) of the Owner and third parties. The Store’s Customer or the person visiting the Online Store website is solely responsible for non-compliance with the provisions of this point.
  5. These Terms&Conditions have been drawn up in the Polish and English language versions. In the event of any discrepancy between Polish (original language version) and English (translated version) versions, the Polish version shall prevail.
  6. These Terms & Conditions are valid from 02/01/2020.
